This is a service agreement (“contract”) between __________ (“Creator”) and the undersigned (“Client”) executed by the Client on this, the _______ day of ________, 20____. The Creator is engaged in the service of syndicating written cartoons to print publications. The Creator will forward a cartoon ________ weeks prior to publication dates assigned by the Client. The Creator is a contributing artist and will perform all acts of delivery, fee and contract negotiations, billing and collections.
Client agrees not to rent, sell, provide, or otherwise dispose of any cartoons provided by Creator with the exception of one-time print rights being assigned by Creator as per this agreement. Additional distribution, print, and electronic rights may be granted by Creator, for an additional fee, on written request by Client.
Client agrees to pay creator for services at the rate of $______ per feature, pursuant to this agreement. Payment for services rendered by creator shall be made by Client within thirty (30) days of submission of the cartoon, payable to the Creator. Late payment charges will accrue monthly at the rate of _______ percent per annum on all past due balances exceeding thirty (30) days. Accounts sixty (60) days past due are subject to contract termination without notice.
Client agrees to provide Creator with a complimentary copy of the newspaper issue in which Creator’s cartoon appears. This issue should be mailed to:____________________________________________.
This contract will continue on a month-to-month basis until either party shall have given the other thirty (30) days written notice of the desire to terminate this agreement, or under the nonpayment terms above.
This contract constitutes the entire understanding and agreement between the parties; it is subject to cancellation only as provided above, and it may not be altered or varied by oral agreement or representatives of any third party.
